Appeals & Litigation
In cases where the client disputes an assessment made by the tax authorities (both LHDNM and / or Customs), ZRp can provide the representation to lodge an appeal against the said assessment. Appeals to the Special Commissioners of Income Tax and/or Customs Appeal Tribunal, appeals to the Courts against the decision thereof and, in certain cases, applications by way of Judicial Review are just some of the services provided by the firm. It is important to note that even though the taxpayer has lodged an appeal against a tax assessment, the tax authorities may still proceed with recovery proceedings in relation to the said assessment. Here, the firm can provide representation to assist the client in either contesting or applying for a stay of the said proceedings while the appeal process is ongoing.
Alternative Dispute Resolution
A number of tax matters do not result in litigation and can be settled by way of settlement discussion, mediation and/or other forms of alternative dispute resolution methods. The team capitalises on its expertise and/or good rapport with the tax authorities in order to assist with the negotiation of settlements and to achieve a satisfactory resolution to the client’s tax issues based on merits and, in some instances, a win-win situation.
